Section 1 Vendor, scope

(1) The vendor and contracting party for the goods offered in the online shop lacueor.com is Finor GmbH, Kurfürstendamm 194, 10707 Berlin, Germany, e-mail info@lacueor.com, registered with the Local Court Berlin-Charlottenburg under HRB 275672 B (hereinafter “we”).

(2) These General Terms and Conditions apply to all orders placed by consumers and businesses through our online shop. Deviating terms of the customer do not become part of the contract unless we expressly agree to them.

(3) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. A business is a natural or legal person or a partnership with legal capacity acting in the exercise of its trade, business or profession when concluding a legal transaction.

Section 2 Conclusion of contract

(1) The presentation of goods in the online shop does not constitute a legally binding offer but an invitation to order. Colours may differ slightly from the goods depending on your screen.

(2) You can place goods in the cart and enter your details at checkout. Before placing the order, all order data is displayed in an overview where you can check and correct it using your browser functions or the edit links. By clicking “Pay now” (or “Complete order”, or the corresponding button of an express payment service such as PayPal, Shop Pay, Apple Pay or Google Pay) you place a binding order for the goods in your cart.

(3) We confirm receipt of the order without delay by e-mail. The purchase contract is concluded with this order confirmation, and at the latest when the goods are shipped. For express payment services, the contract is concluded when the payment process is completed.

(4) We store the contract text and send it to you by e-mail together with these terms and the withdrawal policy. You can view your orders in your customer account. The contract language is German or English at your choice.

Section 3 Prices and payment

(1) All prices are final prices in euros including statutory VAT, plus shipping costs according to our Shipping Policy. For goods offered by volume or weight, we additionally show the unit price.

(2) The payment methods shown at checkout are available, currently: credit card (Visa, Mastercard, American Express), Apple Pay, Google Pay, Shop Pay, PayPal, Klarna and payment in advance by bank transfer. The purchase price is due upon conclusion of the contract. For payment via Klarna, Klarna’s terms shown at checkout apply in addition.

(3) For payment in advance by bank transfer, the purchase price must be paid to the stated account within seven days of the order confirmation. We reserve the goods for this period; if payment is not received in time, we may withdraw from the contract.

(4) For deliveries to countries outside the European Union, customs duties, taxes and fees may apply, which you pay to the customs authority or carrier on delivery. These charges are not included in the purchase price and are not collected by us.

Section 4 Delivery

(1) We deliver to the countries selectable at checkout. Delivery times and shipping costs are set out in our Shipping Policy and on the respective product page. Delivery periods begin upon receipt of payment and are stated in business days (Monday to Friday, excluding public holidays).

(2) Several goods ordered together are shipped in one parcel; the longest delivery time applies. If you want separate delivery, please order the goods separately.

(3) If a delivery fails because you provided an incorrect or incomplete shipping address, we will ship again once you have covered the actual cost of re-shipping.

(4) For consumers, the risk of accidental loss or deterioration of the goods passes upon handover to the consumer. For businesses, the risk passes upon handover to the carrier.

Section 5 Retention of title

The goods remain our property until paid in full.

Section 6 Right of withdrawal

Consumers have a statutory right of withdrawal. Details, exclusions and the model withdrawal form can be found in our Right of Withdrawal policy. We grant consumers habitually resident outside Germany the right of withdrawal under German law even if their national law provides for no or a shorter right of withdrawal.

Section 7 Warranty

(1) Statutory warranty rights apply.

(2) Cosmetic products are natural products. Minor variations in colour, scent and consistency between batches are due to the production process and do not constitute a defect. Please observe the instructions for use on the packaging and product page.

(3) For businesses, the warranty period for new goods is one year from delivery. This reduction does not apply to claims for damages under Section 8.

Section 8 Liability

(1) We are liable without limitation for damages resulting from injury to life, body or health, in cases of intent and gross negligence, fraudulent concealment of a defect, assumption of a guarantee, and under the German Product Liability Act.

(2) In the event of a slightly negligent breach of an essential contractual obligation (an obligation whose fulfilment is essential for the proper performance of the contract and on whose observance you may regularly rely), our liability is limited to the foreseeable damage typical for the contract.

(3) Any further liability is excluded.

Section 9 Dispute resolution

We are willing to participate in dispute resolution proceedings before the Universalschlichtungsstelle des Bundes, Zentrum für Schlichtung e. V., Straßburger Straße 8, 77694 Kehl, Germany, www.verbraucher-schlichter.de.

Section 10 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory consumer protection provisions of the state of their habitual residence.

(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is Berlin.

(3) Should individual provisions of these terms be invalid, the validity of the remaining provisions remains unaffected.
